Gabriola Island Community Health and Wellbeing Contribution Service

Establishment Bylaw No. 1892, 2023

NOTICE IS HEREBY GIVEN pursuant to Section 86 of the Community Charter that the Board of the Regional District of Nanaimo (RDN) intends to adopt “Gabriola Island Community Health and Wellbeing Contribution Service Establishment Bylaw No. 1892, 2023” (“Bylaw No. 1892”) to establish a service for the purpose of providing a contribution towards community health and wellbeing initiatives within a portion of Electoral Area B (Gabriola Island) (the “Service Area”).

FURTHER NOTICE IS HEREBY GIVEN that the RDN Board may proceed with the adoption of Bylaw No. 1892 unless, by the deadline, Elector Response Forms are certified by the Corporate Officer as having been signed by at least 10% of the electors of the Service Area indicating that the Board must obtain the assent of the electors in a voting proceeding (referendum) before proceeding. Elector Response Forms must be given in the form established by the RDN Board and will be provided to electors of the Service Area upon request. A copy of Bylaw No. 1892 is available for public inspection and Elector Response Forms can be obtained on the RDN website at www.rdn.bc.ca, and at the Administration Office of the Regional District of Nanaimo located at 6300 Hammond Bay Road, Nanaimo, BC, V9T 6N2, Phone 250-390-4111 or toll free 1-877-607-4111, from January 10, 2024 to February 20, 2024 during regular office hours: Monday to Friday from 8:30 am – 4:30 pm, excluding statutory holidays.

Deadline

Signed Elector Response Forms must be received by the Corporate Officer at the Regional District of Nanaimo, 6300 Hammond Bay Road, Nanaimo, BC V9T 6N2 by 4:00 pm on Tuesday, February 20, 2024 to be counted. The Elector Response Form may be submitted by email to vote@rdn.bc.ca or by fax to 250-390-4163.

Alternative Approval Process

The only persons entitled to sign the Elector Response Forms are the electors in the Service Area (Gabriola Island) which is the area to which the approval process applies. Eligible electors are persons meeting all of the following Resident or Non- Resident Property Elector qualifications:

A Resident Elector must:

  • be 18 years of age or older;
  • be a Canadian citizen;
  • have been a resident of British Columbia for at least 6 months immediately before signing the Elector Response Form;
  • be a resident within the Service Area before signing the Elector Response Form; and
  • not be disqualified by any enactment from voting in an election or be otherwise disqualified by law.

A Non-Resident Property Elector must:

  • not be entitled to register as a resident elector in the Service Area;
  • be 18 years of age or older;
  • be a Canadian citizen;
  • have been a resident of British Columbia for at least 6 months immediately before signing the Elector Response Form;
  • have been a registered owner of real property within the Service Area for at least 30 days before signing the Elector Response Form;
  • not be disqualified by any enactment from voting in an election or be otherwise disqualified by law; and
  • not hold the property in trust for a corporation or another trust.

Note:

  • If a property is owned by more than one individual, only one of them may sign an elector response form (with the written consent of the majority of the owners);
  • A person may register as a non-resident property elector in relation to only one parcel of real property in the Service Area;
  • There is no Corporate Vote - No corporation is entitled to be registered as an elector or have a representative registered as an elector and no corporation is entitled to vote.

For the purpose of conducting this elector response opportunity, the total number of electors is determined to be 3,928. If less than 10% (392) of the electors of the Service Area sign and submit an Elector Response Form to the Regional District of Nanaimo by the deadline, the RDN Board may proceed to adopt Bylaw No. 1892. If 392 or more electors sign and submit Elector Response Forms by the deadline, Bylaw No. 1892 cannot be adopted by the RDN Board without obtaining the assent of the electors in a voting proceeding (referendum).
